1. Introduction
This privacy notice explains how Endlesss (“we”, “us”, “our”) collects and processes personal data through the website at endlesss.ai, and in the course of correspondence and client work arising from it. It is provided in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
2. Data controller
Endlesss is a studio operated as a sole trader in London, United Kingdom, and is the data controller in respect of the personal data described in this notice. Enquiries concerning this notice, or any request to exercise the rights set out in section 8, should be addressed to hello@endlesss.ai.
3. Personal data we collect
This website contains no forms and no account system. We collect the following categories of personal data:
- Technical data. Our hosting provider records each request made to the website, including IP address, the page requested, the date and time, and browser and device information.
- Usage data. Where, and only where, you have given consent through the cookie notice, an analytics service records the pages you view and the time spent on them, associated with an identifier stored in your browser.
- Correspondence data. Where you contact us by email or book a call, we hold the contact details you provide and the content of that correspondence.
- Client data. Where a project proceeds, we hold the information necessary to perform the contract and to meet our statutory record-keeping obligations, including invoicing records.
4. Purposes and lawful bases
We process personal data on the following lawful bases:
- Consent. Analytics cookies and the usage data derived from them. Consent may be withdrawn at any time through the Cookies link in the footer of every page: choosing Decline records the withdrawal, removes the analytics cookies from your browser and stops the analytics script loading.
- Legitimate interests. Responding to enquiries, maintaining the security and availability of the website, and keeping records of business correspondence. We consider these interests not to be overridden by your rights and freedoms.
- Performance of a contract. Delivering commissioned work and administering the engagement.
- Legal obligation. Retaining accounting and tax records.
5. Cookies
No cookies are set when you first visit this website. A cookie notice is presented on your first visit; analytics cookies are set only if you accept. If you decline, or take no action, no analytics script is loaded and no analytics cookie is set. Your choice is recorded in your browser and is retained for twelve months, and can be changed at any time through the Cookies link in the footer. This website carries no advertising cookies and participates in no advertising network.
6. Recipients and processors
We do not sell personal data and do not disclose it to third parties for their own marketing purposes. Personal data is processed on our behalf by the following service providers, each acting under contract and on our instructions:
- Cloudflare, Inc. Website hosting and content delivery.
- HubSpot, Inc. (EU region) Website analytics, call bookings and enquiry records.
- Google LLC. Email services for hello@endlesss.ai, and the delivery of two typefaces used on this website. Requesting those typefaces discloses your IP address to Google.
We may also disclose personal data where required to do so by law, or to establish or defend legal claims.
7. International transfers
Certain of the providers listed above process personal data outside the United Kingdom. Where this occurs, the transfer is made under an adequacy decision or under the International Data Transfer Agreement or equivalent standard contractual clauses, together with such supplementary measures as are appropriate.
8. Retention
Technical data is retained by our hosting provider in accordance with its own retention schedule. Analytics data is retained in accordance with the analytics provider’s schedule. Enquiries that do not lead to an engagement are deleted within two years. Records relating to paid work, including invoices and the agreements to which they relate, are retained for six years following the end of the relationship, in accordance with UK tax requirements.
9. Your rights
Subject to the conditions and exemptions in the applicable legislation, you have the right to request access to your personal data; to request rectification of inaccurate data; to request erasure; to request restriction of processing; to object to processing carried out on the basis of legitimate interests; to data portability; and to withdraw consent where processing is based on consent.
Requests should be made to hello@endlesss.ai and will be answered within one month of receipt.
10. Complaints
If you are dissatisfied with how we have handled your personal data, you may lodge a complaint with the Information Commissioner’s Office, the United Kingdom supervisory authority for data protection, at ico.org.uk or by telephone on 0303 123 1113. We would ask that you raise the matter with us first.
11. Children
This website is directed at businesses commissioning creative work. It is not directed at children and we do not knowingly collect personal data relating to them.
